The terms and conditions for registration and participation in Swing Busters courses (hereinafter referred to as the "Terms")

  1. Introduction
    1. What is it about? These terms and conditions have been created by us, Swing Busters s.r.o., with company ID 04697359, located at Primátorská 296/38, Libeň, 180 00 Prague 8 (hereinafter also referred to as “Swing Busters“), mainly for you, the participants, to have all the rules related to attending our lessons and other events in one place. Therefore, these terms apply to contracts made through the web interface www.swingbusters.cz (hereinafter “the website“), under which we primarily teach you to dance and engage in other physical activities (according to the course specifications for which you register) in our leisure-time educational courses (hereinafter “courses” and “Contracts“). These Terms contain important information, such as how our courses are conducted, how to register for courses via our website, deadlines for payments, behavior rules during lessons, and also all the legal instructions required by law.
    2. Agreement to the Terms. By verifying your email address when you first register for a course (as described in section 2.4), you confirm that you have read the current version of these Terms, agree to them, and will follow them. You also guarantee that you are legally capable of entering into a contract, particularly with respect to your age, or are represented by a legal guardian, and that all information you provide to Swing Busters is complete, truthful, correct, and accurate. You provide this consent and declaration each time you register for a course via our website.
    3. Version of the Terms. We may change and supplement these Terms, but we will always publish the updated version on the website, and for your course, the version that was current at the time of your registration will apply.
    4. Processing of Personal Data. By registering for a course, you also agree to the processing of your personal data for the purposes of course registration and lesson participation, including the possible recording of your likeness in videos from the lessons. You also acknowledge the “Personal Data Processing Rules.” During registration, you may voluntarily subscribe to our informational newsletter and agree to participate in a satisfaction survey about our courses.
  2. Registration for Courses
    1. Course Specifications. In each lesson of the course, our instructors will teach you dance or other activities as specified in the course description. A detailed course schedule is published on our website. On the website, you can find information about the course title, content, who can register, the course capacity, the number of available spots, the number of lessons, the lesson schedule, the location, the instructors, and the registration period, as well as the possibility of a discount and the conditions under which it can be applied.
    2. Changes and Cancellations. We reserve the right to change the specifications of our courses or even cancel a course entirely (we do this reluctantly, mainly for operational reasons), even if some lessons have already taken place. If we make a significant change to the location or time of the lessons in your course, you can cancel the Contract by sending an email to info@swingbusters.cz, and we will refund the proportionate part of the course fee for the lessons that are affected by the change (cancellation). If we cancel the course, we will refund the proportionate part of the course fee for lessons that have not taken place. If we are unable to hold the courses due to no fault of our own, for example, due to public health measures, we reserve the right to move the lessons to a time when the obstacle has passed (in such cases, you will not have the right to cancel the Contract due to a change in course specifications as described above) or cancel the course and refund the proportionate part of the course fee.
    3. Course Registration Information. When registering for a course, you will provide the following information on the website: (i) your email address, (ii) whether you will participate as a “leader” or “follower,” (iii) whether you are a student under 26 years old and wish to apply for a discount (please be prepared to provide a student confirmation on the first lesson), (iv) whether you are registering with a dance partner (if the course allows for partner registration), and (v) your dance partner’s email address. By completing and submitting this registration form, you express your interest in entering into a Contract.
    4. First Registration. Upon your first course registration, we will send you and possibly your dance partner (if registered by you) a link to verify your email address. This verification will also complete your registration and give you access to our web portal, where you can check your registered courses, payment details, and other useful information.
    5. Waiting list. Please note that there is no entitlement to acceptance into a course. This applies especially if you register for a course that has already reached full capacity or, if it is a partner dance course, your registration would result in an uneven number of participants in the roles of “leader” and “follower.” In such cases, your registration will be placed on a waitlist, and you will be notified by email. Please be aware that your registration will only be accepted from the waitlist if a spot becomes available or if a participant in the opposite role registers. If you no longer wish to wait on the waitlist, you can cancel your registration via our portal.
    6. Acceptance of Registration. Upon acceptance of your registration, we confirm that we have accepted your registration and that a spot is available for you in the course, meaning you only need to pay the course fee. We will notify you of the acceptance by email with a link to our portal, where you will see the payment details for the course fee, including the payment deadline. If you decide not to attend the course at this stage, you can cancel your registration through the portal, and we will not ask you to pay the course fee.
    7. Conclusion of the Contract. By displaying the payment details on our portal (clicking the “PAY…” button), the Contract between you and Swing Busters regarding the course(s) you have been accepted into is concluded. From this point, we will rely on your participation, and you commit to paying the course fee according to these Terms, possibly also for your dance partner, if you listed one during registration. Once the payment details are shown, you can no longer cancel your registration.
    8. Cancellation of Registration. If the course fee is not paid by the payment deadline as stated in section 3.3 of these Terms, we have the right to withdraw from the Contract and cancel your registration. You will be notified of this cancellation by email. If registration was done with a dance partner and only one of you has paid, we will unfortunately need to cancel both registrations. The paid course fee will usually be refunded within 14 days after the cancellation, but we reserve the right to seek compensation for any damages caused by blocking the spot in the course.
  3. Courses Fee
    1. Course Fee. You pay the course fee for participation in a course. The fee includes VAT. Payments are made via bank transfer to the Swing Busters account provided in the payment details. The current course fee, including any discounts, can be found in the price list on our website and in the registration form for each course. The fee displayed on the website at the time of registration can be further reduced by a quantity discount as explained in section 3.2 below. The final amount (after any quantity discount) is shown on our portal once the payment details are displayed. If the course fee displayed on the website or in the payment details is clearly incorrect, we reserve the right to withdraw from the Contract.
    2. Quantity Discounts. The course fee may be reduced by a quantity discount according to the current offer listed in the price list on our website. The quantity discount can be combined with other discounts, unless otherwise stated in the price list. The quantity discount applies if you have already registered and paid for more than one course in the same semester or if you pay for two or more courses in the same semester simultaneously. The discount is always deducted from the course fee of the course that activates the discount. For example: The first course is at the full fee, the fee for the second course is reduced by the discount for 2 courses, and the fee for the third course is reduced by the discount for 3 courses. If you cancel registration for a course that activated the quantity discount (see section 2.8), you will lose the discount and be asked to pay the original fee (without the quantity discount) for the second or any subsequent course.
    3. Payment Due Date. If your registration is accepted more than 4 days before the course registration deadline, the course fee is due within 3 days from when the payment details are sent. If your registration is accepted 4 days or less before the deadline, the fee is due by the second day after the acceptance email. We recommend paying the course fee promptly after receiving the acceptance email, or using instant payment options provided by many banking apps. We will remind you of the approaching payment deadline by email. If you opt to pay in two installments, the first installment (50% of the course fee) follows the payment rules outlined above, while the remaining 50% is due by the pre-set date for that registration period.
    4. Moment of Payment. The course fee is considered paid when the payment is received and properly credited to Swing Busters’ bank account according to the payment details.
    5. Missed class substitution. If you miss a lesson from a pre-paid course, you can make it up by attending one of the Open Class lessons during the current semester. These lessons cannot be pre-registered for, and capacity is filled on a “first-come, first-served” basis. Please note that if the Open Class is full, you cannot use it as a make-up lesson. In case of repeated absences, no refund will be given for missed lessons.
    6. Cancellation Policy. In the case of cancelling your participation in a course before its start (up to 7 days before the course begins), we charge a cancellation fee of CZK 200, which will be deducted from the amount refunded to you. The amount can also be transferred to a credit and used to pay for future courses and workshops. In this case, the full amount will remain as credit. If you cancel your participation in the course less than 7 days before its start, we charge a 50% cancellation fee, or you can transfer the full amount to credit for future courses/workshops. In case of cancellation due to serious health reasons (e.g., a broken leg, surgery, etc.), it is possible to transfer a proportional amount to credit during the course, which can be used in the future. If the course is cancelled by us, you will receive a full refund, or we can offer you an equivalent substitute, such as another course/workshop, or transfer the full paid amount to your student credit. Switching from one course to another is possible free of charge, subject to agreement.
    7. Proof of Payment. After paying the course fee, we will send you an email confirming the payment and final registration for the course. If requested, we will also send you a payment receipt and confirmation of the service provided via email.
  4. Rules for Participation in Lessons and Other Events Organized by Swing Busters
    1. Basic Rules. All course participants behave politely and considerately towards others, are not under the influence of alcohol or other intoxicants, and adhere to basic hygiene habits and the instructor’s guidelines.
    2. Personal Safety. Participation in courses is at your own risk. If you’re unsure about your health condition, consult your doctor before attending the lessons.
    3. Dance Shoes. Participants are required to change into appropriate footwear in the dance halls (see recommendations in the FAQ section on our website) and behave in a way that prevents the dance floor from getting dirty or damaged.
    4. Personal Belongings. During lessons, place your belongings only in designated areas as directed by the instructor. Do not leave valuables in these areas; it’s better to leave them at home.
    5. Rotation. In partner dance lessons, we practice “rotation,” which means you will dance with various partners in different roles. If you are attending the course with a partner and do not wish to rotate, inform the instructors before the first lesson or at another appropriate time.
    6. Violation of Conditions. As a course participant, you acknowledge and agree that in the case of significant violation of the rules outlined in these Conditions, we may limit or prohibit your participation in lessons and other events organized by Swing Busters. In such a case, you will not be entitled to a refund for lessons you cannot attend due to the violation.
  5. Consumer Rights
    1. Website Access and Use. Access to and use of our website is free of charge, but you are responsible for any costs incurred related to accessing and using the website (e.g., internet connection costs).
    2. Contract Formation and Consumer Rights. Although the contract is concluded online, which is a form of distance contract, you do not have the right to withdraw from the contract without giving a reason within 14 days. This applies to contracts for leisure services, where we provide the service (lessons) on a specific date (Section 1837, item j of the Civil Code).
    3. Right to Withdraw from Contract. You can withdraw from the contract if Swing Busters breaches the contract in a significant way, without undue delay after you become aware of the breach. You must inform us of your withdrawal by email at info@swingbusters.cz. In such a case, we will refund your course fee or its proportional part without undue delay, and no later than 14 days after receiving your withdrawal request.
    4. Service Quality and Defects. As a business, we are obliged to provide the service in accordance with the contract, without legal or factual defects, in the agreed quantity, quality, and execution. If this is not the case, you have rights regarding defective performance according to applicable laws (Sections 1914–1925, 2099–2117, and 2158–2174 of the Civil Code). If you are not satisfied with the quality of the lessons, please let us know at info@swingbusters.cz or through our satisfaction survey. However, we do not guarantee that you will become a “Frankie Manning” after nine lessons, meaning we do not guarantee the outcome of the service we provide during lessons.
    5. Complaints. If you decide to file a complaint, you must report the defect in the service in writing (by post or email to info@swingbusters.cz) as soon as possible, but no later than six months after the service was provided. We must address the complaint within 30 days unless otherwise agreed.
    6. Alternative Dispute Resolution. If a dispute cannot be resolved directly, it can be resolved through out-of-court consumer dispute resolution. The Czech Trade Inspection Authority (www.coi.cz) is the relevant body for such disputes.
  6. Intellectual Property Rights
    1. The website and its content are owned by Swing Busters, unless otherwise stated. The content, including videos and photos, is subject to intellectual property rights, particularly copyright law (Act No. 12/2000 Sb.).
    2. You may not store, modify, distribute, duplicate, publish, upload, distribute, translate, or exercise any proprietary rights over the content of the website without Swing Busters’ consent.
    3. All intellectual property rights (including copyrights, trademarks, industrial designs, database rights, etc.) concerning the content on the website belong to Swing Busters, unless expressly stated otherwise.
  7. Final Provisions
    1. Governing Law. The contract between you and Swing Busters and other related legal relationships are governed exclusively by the laws of the Czech Republic, particularly Act No. 89/2012 Sb., the Civil Code, and Act No. 634/1992 Sb., on Consumer Protection, regardless of where you are accessing the website from.
    2. Severability. If any provision of these Terms is invalid or ineffective, the validity of the remaining provisions will not be affected, and we will treat the invalid or ineffective provision as if it were not included.
    3. Contract Duration. Services under the contract are provided for the duration of the specific course. The duration of the course also determines the duration of the contract, so the contract ends after the last lesson of the course.
    4. Contract Terms and Priority. The contract consists of these Terms, your registration, and payment information. If we publish information on the website that deviates from these Terms and this change benefits you, or if we inform you of this change before concluding the contract (e.g., by email), this change takes precedence over the Terms.
    5. Language of Contract. The contract is concluded in Czech, unless otherwise agreed upon.

    6. Effectiveness. These Terms are effective from July 31, 2020.
